1. Agreement to Terms

By accessing or using the FallbackFunds website and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use our Services. These Terms constitute a legally binding agreement between you and FallbackFunds, Guiding Light Partners, and Loophole Lending (collectively, "we," "us," or "our").

4. No Guarantees or Warranties

4.1 Results Not Guaranteed

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

5.1 FallbackFunds, Guiding Light Partners, Loophole Lending, and their respective officers, directors, employees, agents, affiliates, and partners SHALL NOT BE LIABLE for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses.

5.2 We SHALL NOT BE LIABLE for any damages resulting from: (a) your use or inability to use our Services; (b) any financial decisions you make based on information from our Services; (c) credit denials, credit score changes, or financial losses; (d) unauthorized access to your information; (e) errors or omissions in our content; (f) any conduct or content of third parties.

5.3 In no event shall our total liability to you for all damages exceed the amount you paid us in the twelve (12) months prior to the event giving rise to liability, or one hundred dollars ($100), whichever is less.

6. User Responsibilities and Acknowledgments

By using our Services, you acknowledge and agree that:

8. Indemnification

You agree to defend, indemnify, and hold harmless FallbackFunds, Guiding Light Partners, Loophole Lending, and their respective officers, directors, employees, agents, affiliates, and partners from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from: (a) your use of our Services; (b) your violation of these Terms; (c) your violation of any rights of another party; (d) any financial decisions or actions you take; or (e) any information you provide to us.

9. Third-Party Services and Links

Our Services may contain links to third-party websites, services, or credit card offers. We are not responsible for the content, accuracy, privacy practices, or terms of any third-party services. Your interactions with third parties are solely between you and the third party. We disclaim all liability for any damages arising from your use of third-party services.

10. Modifications to Services and Terms

We reserve the right to modify, suspend, or discontinue our Services (or any part thereof) at any time without notice or liability. We also reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of our Services after any changes constitutes acceptance of the modified Terms.

11. Termination

We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use our Services will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Dispute Resolution and Arbitration

12.1 Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or our Services shall be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

12.2 Class Action Waiver

You agree that any arbitration or proceeding shall be limited to the dispute between you and us individually. To the full extent permitted by law, (a) no arbitration or proceeding shall be joined with any other; (b) there is no right or authority for any dispute to be arbitrated on a class-action basis or to utilize class action procedures; and (c) there is no right or authority for any dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.

12.3 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

13. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding our Services and supersede all prior agreements and understandings, whether written or oral.

YOU AGREE THAT FALLBACKFUNDS, GUIDING LIGHT PARTNERS, AND LOOPHOLE LENDING SHALL NOT BE LIABLE FOR ANY DAMAGES OR LOSSES ARISING FROM YOUR USE OF OUR SERVICES.
